Welcome to AudioCatch ("the Extension," "we," "us," "our," or "Company"). These Terms of Service ("Terms") constitute a legal agreement between you ("User," "you," or "your") and AudioCatch. By installing, accessing, or using the AudioCatch Chrome extension, you agree to be bound by these Terms. If you do not agree to these Terms, do not install or use AudioCatch.

2. Description of Service

AudioCatch is a Chrome extension designed to:

  • Capture audio from YouTube videos you are watching
  • Identify songs playing using advanced AI technology
  • Display song information including title, artist, and album
  • Provide links to streaming platforms
  • Allow you to save and bookmark identified songs

We reserve the right to modify, suspend, or discontinue the Extension or any part of it at any time, with or without notice.

3. License and Authorization

3.1 Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use AudioCatch on your personal device for personal, non-commercial purposes only.

3.2 Restrictions

You agree NOT to:

  • Modify, reverse engineer, decompile, or disassemble the Extension
  • Attempt to bypass or circumvent security features
  • Use the Extension for commercial purposes
  • Redistribute, sell, rent, or lease the Extension
  • Use the Extension to identify copyright-protected works for unauthorized distribution
  • Remove or alter any proprietary notices, labels, or marks
  • Interfere with the proper functioning of the Extension or our servers
  • Scrape data from our services without authorization

3.3 Intellectual Property Rights

AudioCatch and all its content, features, and functionality (including but not limited to all information, software, code, designs, graphics, and interfaces) are owned by AudioCatch, our licensors, or other providers of such material and are protected by international copyright, trademark, and other intellectual property laws.

4. User Responsibilities

4.1 Applicable Laws

You agree to use AudioCatch in compliance with all applicable laws, regulations, and third-party rights. You are solely responsible for ensuring your use complies with local, state, national, and international laws.

4.2 Prohibited Conduct

You agree NOT to use AudioCatch to:

  • Infringe upon any copyright, trademark, or intellectual property rights
  • Harass, threaten, abuse, or defame any person or entity
  • Transmit viruses, malware, or any malicious code
  • Engage in unlawful activity or fraud
  • Violate YouTube's Terms of Service or any platform's terms you access through AudioCatch
  • Collect or process data directly from YouTube without authorization
  • Create derivative works for commercial purposes

4.3 Content Responsibility

You are responsible for the content you identify and save through AudioCatch. We do not endorse, guarantee the accuracy of, or assume liability for any user-identified content.

5. Intellectual Property and Copyright

5.1 Music Identification

AudioCatch identifies music using:

  • Licensed music databases and APIs
  • Advanced AI technology (analyzing audio patterns and characteristics, not storing original audio)
  • Third-party music identification services

5.2 Your Responsibilities

You understand that:

  • Identified songs remain the property of their respective rights holders
  • AudioCatch only provides information; it does not grant you rights to the music
  • Further use of identified music (downloading, streaming, distributing) must comply with applicable copyright laws and the terms of the music platform
  • You are responsible for complying with YouTube's Terms of Service when using our Extension

5.3 DMCA Compliance

AudioCatch complies with the Digital Millennium Copyright Act (DMCA) and does not facilitate unauthorized circumvention of copyright protection measures. We respect intellectual property rights and will respond to valid DMCA takedown notices.

6. Third-Party Services and Content

6.1 Third-Party Links

AudioCatch may provide links to third-party services (Spotify, Apple Music, YouTube Music, etc.). We do not endorse or assume responsibility for these third-party services or their content. Your use of third-party services is governed by their own terms and policies.

6.2 Third-Party APIs

AudioCatch relies on third-party music identification services and databases. These services are provided "as-is" and may be subject to interruption, errors, or changes. We are not liable for any issues arising from third-party services.

6.3 Linked Content

We are not responsible for the availability or accuracy of content linked to from AudioCatch, including information about songs, artists, or streaming platforms.

7. Disclaimer of Warranties

AudioCatch IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY
  • COMPLETENESS
  • RELIABILITY

We make no warranty that AudioCatch will:

  • Identify every song accurately
  • Function without errors or interruptions
  • Be compatible with all versions of Chrome or all websites
  • Meet your specific needs or expectations

Your use of AudioCatch is at your own risk.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AudioCatch AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or revenue
  • Loss of goodwill or reputation
  • Business interruption
  • Data breaches or unauthorized access
  • Errors in song identification
  • Any other damages arising from your use of AudioCatch

This limitation applies even if we have been advised of the possibility of such damages. Our total liability to you shall not exceed $1.00 USD.

9. Indemnification

You agree to indemnify, defend, and hold harmless AudioCatch, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of AudioCatch
  • Your violation of these Terms
  • Your violation of any applicable law or third-party rights
  • Any content you identify or save using AudioCatch
  • Your infringement of any intellectual property rights

10. Termination

10.1 By You

You may terminate your use of AudioCatch at any time by uninstalling the extension from your browser. Upon uninstallation, your local data will be removed from your device.

10.2 By Us

We may suspend or terminate your access to AudioCatch at any time, with or without cause or notice, if we believe you are violating these Terms or applicable laws. Reasons for termination may include:

  • Violation of these Terms of Service
  • Infringement of intellectual property rights
  • Attempt to circumvent security or abuse the service
  • Unlawful activity

10.3 Effects of Termination

Upon termination:

  • Your license to use AudioCatch is immediately revoked
  • You must cease all use of the Extension
  • We may delete your data (though local data may persist unless you uninstall)

Fair Usage Policy

AudioCatch Pro includes unlimited song detection for normal individual use. To keep performance fast and reliable for everyone, all usage is subject to this Fair Usage Policy.

What Fair Usage Means

  • Use is intended for personal, human-driven listening and discovery.
  • Automated, scripted, or bulk detection activity is not allowed.
  • Attempts to overload, stress-test, or abuse the service are prohibited.
  • Use of multiple accounts or installs to bypass safeguards is prohibited.

Enforcement

If usage patterns materially affect platform stability, security, or other users, we may apply temporary rate limits, request verification, suspend access, or terminate accounts in line with these Terms.

We may update this policy from time to time to maintain a reliable service. Continued use of AudioCatch after an update indicates acceptance of the updated Fair Usage Policy.

11. Privacy and Data

Your use of AudioCatch is also governed by our Privacy Policy. Please review the Privacy Policy to understand our practices regarding data collection and use.

12. Modifications to Terms

We may modify these Terms at any time by updating this page. We will notify you of significant changes by:

  • Posting the updated Terms on this page
  • Updating the "Last Updated" date
  • Sending you a notification through the Extension (for material changes)

Your continued use of AudioCatch after changes become effective constitutes your acceptance of the updated Terms.

13. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or, if not possible, severed. The remaining provisions shall continue in full force and effect.

14. Governing Law and Jurisdiction

BY INSTALLING AND USING AudioCatch, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS OUTLINED IN THIS AGREEMENT. IF YOU DO NOT AGREE, PLEASE DO NOT USE AudioCatch.
